Fraud

Fraud occurs when: (a) a person makes a false statement; (b) regarding a material fact; (c) intending that the recipient of the information will rely upon said false statement; and, (d) that causes damages to the recipient. Fraud claims can also occur when a person intentionally fails to disclose material information which, reasonably, should be disclosed.
Claims for Fraudulent Non-Disclosure often arise in real estate transactions. Buyers claim that the Sellers failed to disclose certain defects with the real estate. However, it is common for Fraud claims to arise in other contract situations as well.
